The Enforcement Action prosecution - 10 APR 90


The Enforcement Action was prosecuted at Liskeard Magistrates Court on 10 APR 90
by Michael Tolley, solicitor to Caradon District Council,
whom Tim Wilmot had never met before.

That Tolley was there suggests a high priority.

Tim Wilmot told the court exactly what had taken place,
including the falsification of the minutes.

The Chairman of The Bench strongly suggested Caradon investigate the matter,
before giving Tim Wilmot a Conditional Discharge.


A Conditional Discharge was a very good result for Tim Wilmot.

The revelations seemed to come as some surprise to Mr Tolley,
who suggested to Tim Wilmot that they meet in his office on 24 APR 90.


In this way, the first of two meetings, each of four hours duration, took place.

Four hour meetings do not take place for minor errors by council staff -
it takes something really serious -
falsification of Planning Committee Minutes, for example.


And Caradon District Council never tried to prosecute the Enforcement again -
presumably to prevent giving Tim Wilmot a public platform
